Fascinatio Sports – Terms and Conditions
1. Applicability
These Terms and Conditions apply to all memberships, training sessions, and services provided by Fascinatio Sports that are entered into digitally through Virtuagym or any other system used by Fascinatio Sports.
2. Membership Agreement
A membership agreement is established once the participant has completed the digital registration process and Fascinatio Sports has confirmed the registration.
The membership is entered into for the agreed contract period as specified during registration. After this period, the membership will automatically continue for an indefinite period and may be cancelled on a monthly basis.
3. Payment
Membership fees are collected monthly in advance by direct debit.
Upon registration, the member pays a one-time fee of €10 for an access key. Loss, damage, or failure to return the key may result in replacement charges.
If a direct debit cannot be processed, the member will receive a payment request. Any administrative and collection costs will be charged in accordance with applicable legal regulations.
4. Cancellation
Membership cancellation must be submitted digitally through the designated channels provided by Fascinatio Sports.
A notice period of one full calendar month applies.
Any outstanding balances must be paid in full before the membership can be terminated.
5. Temporary Suspension
Temporary suspension of a membership is only possible in cases of long-term illness, injury, pregnancy, or other serious medical circumstances.
Suspension will only be granted upon submission of a valid medical certificate and approval by Fascinatio Sports.
6. Minors
For participants under the age of 18, digital registration must be completed or approved by a parent or legal guardian.
7. House Rules
Members are required to:
Wear clean sports clothing and clean athletic footwear; Use a towel during workouts; Use equipment correctly and safely; Return equipment and materials after use; Treat fellow members and staff with respect; Follow instructions given by staff members. Smoking, alcohol consumption, drug use, and inappropriate behavior are strictly prohibited within the facility.
Fascinatio Sports reserves the right to temporarily or permanently deny access to individuals who fail to comply with the house rules.
8. Safety and Health
Participation in training sessions and use of the facilities are entirely at the member’s own risk.
Members declare, to the best of their knowledge, that they are in good health and physically capable of participating in sports activities. If there is any doubt regarding health conditions, members are advised to consult a physician before participating.
9. Liability
Fascinatio Sports is not liable for loss, theft, or damage to personal belongings.
Fascinatio Sports shall only be liable for damages that are the direct result of intentional misconduct or gross negligence by Fascinatio Sports or its employees.
Any liability is limited to the amount paid out by the liability insurance of Fascinatio Sports in the relevant case.
10. Opening Hours and Facilities
Fascinatio Sports determines its opening hours and reserves the right to adjust them temporarily due to maintenance, public holidays, vacations, emergencies, or other circumstances.
Temporary closure does not entitle members to a refund of membership fees unless the closure continues for an extended period and cannot reasonably be attributed to the member.
11. Late Payments
In the event of overdue payments, the member will receive a payment reminder.
If payment remains outstanding, Fascinatio Sports may suspend access to its facilities and transfer the claim to a debt collection agency.
Any statutory collection costs and legal expenses incurred will be borne by the member.
12. Privacy
Personal data is processed in accordance with the General Data Protection Regulation (GDPR).
Personal data is used solely for administration, communication, and the provision of services by Fascinatio Sports and will not be shared with third parties without consent unless required by law.
13. Amendments to the Terms and Conditions
Fascinatio Sports reserves the right to amend these Terms and Conditions.
Members will be informed of any amendments in a timely manner. Amendments shall take effect on the announced effective date.
14. Final Provisions
By entering into the agreement digitally, the member confirms that they have read, understood, and accepted these Terms and Conditions.
All agreements between the member and Fascinatio Sports shall be governed exclusively by Dutch law.
